1. Agreement to Terms
By accessing or purchasing from MRKByDesign (“we,” “us,” “our,” operated at mrkbydesign.com), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this site.
2. About This Site
MRKByDesign is an online marketplace featuring original artwork from MRK and independent artists (“Artists”) who sell their designs on print-on-demand (“POD”) products such as apparel, drinkware, wall art, and accessories. Each product is manufactured only after it is ordered by a customer.
3. Products and Print-on-Demand Fulfillment
Products are produced on demand by third-party fulfillment partners (currently Gelato). Because items are made to order:
- Colors, sizes, and print placement may vary slightly from the on-screen preview due to differences in materials, printing methods, and monitor display.
- Production and shipping times vary by product and fulfillment partner and are estimates, not guarantees.
4. Intellectual Property
All artwork, designs, and images displayed on this site remain the intellectual property of the Artist who created them (or MRK, for MRK’s own designs). Purchasing a product grants you no rights to reproduce, redistribute, or use the artwork outside of the physical item you purchased. Unauthorized reproduction, resale, or use of any design is prohibited.
Artists selling on this platform represent and warrant that they own the rights to the artwork they upload, or have the necessary permissions/licenses to sell it, and that it does not infringe on any third party’s copyright, trademark, or other intellectual property rights.
5. Orders, Pricing & Payment
All prices are listed in USD and are subject to change without notice. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or unavailability of materials. Payment is processed securely at checkout; we do not store your full payment card details.
6. Shipping & Delivery
Shipping costs and estimated delivery windows are calculated at checkout based on your location and the fulfillment partner(s) producing your order. Orders containing designs from multiple Artists or fulfillment partners may arrive in separate shipments. We are not responsible for delays caused by the shipping carrier, customs, or events outside our control.
7. Returns, Refunds & Exchanges
Because every item is printed to order, we do not accept returns or exchanges for change of mind, ordering the wrong size or color, or similar reasons. We will send a free replacement, or a refund, if:
- The item arrives damaged or defective, or has a print error;
- The item is materially different from what you ordered (wrong design, product, size, color or quantity); or
- Your package is lost in transit.
Claims must be sent within 30 days of delivery (for lost packages, within 30 days of the estimated delivery date), with your order number and photos of the issue, to mark@mrkbydesign.com. You do not need to return the item. Custom design work is non-refundable once you approve the proof, unless there is a print error. Small color differences from your screen are normal and are not a defect. Approved refunds are issued to the original payment method. Full details are in our Refund and Returns Policy.
8. Accounts
Customers may check out as a guest or create an account. Artists selling on the platform are provided a separate Artist account with access limited to their own designs, sales, and earnings. You are responsible for keeping your account credentials confidential and for all activity under your account.
9. Prohibited Content & Conduct
Artists may not upload designs that: infringe on any copyright, trademark, or publicity right; contain hate speech, harassment, or content sexualizing minors; are otherwise illegal; or violate the policies of our fulfillment partners. We reserve the right to remove any listing and suspend any account at our discretion.
10. Artist Payouts
Artists are paid according to the commission structure disclosed to them at signup. Payout schedules, minimum thresholds, and methods are described in the Artist Dashboard and may be updated from time to time with notice to Artists.
11. Limitation of Liability
To the fullest extent permitted by law, MRKByDesign and its owners are not liable for any indirect, incidental, or consequential damages arising from your use of this site or purchase of any product. Our total liability for any claim is limited to the amount you paid for the product giving rise to the claim.
12. Disclaimer of Warranties
This site and its products are provided “as is” without warranties of any kind, express or implied, except as required by law.
13. Changes to These Terms
We may update these Terms and Conditions from time to time. Continued use of the site after changes are posted constitutes acceptance of the updated terms.
14. Governing Law
MrKByDesign operates from Florida and Connecticut and sells to customers in every U.S. state. These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Nothing in these terms limits any rights you have under the consumer protection laws of the state where you live.
